Terms of Service

This is a legal agreement (“Agreement”) between you and IAA Social Networking Private Limited (“IAA”), a company registered under the Companies Act, 1956 and having its registered office at A-178, Ground Floor, C-3, Saini Bhawan, Bhisham Pitamah Marg, Kotla Mubarakpur, New Delhi - 110013, India By indicating your acceptance using the checkbox on the Joining page, and by accessing www.datedosti.com™ (the “Site”), or using any of the Services (as defined below) accessible through the Site, you become a user and agree to, and are bound by, the terms and conditions of this Agreement and the accompanying Privacy Policy for as long as you continue to use the Site or Services.  IF YOU DO NOT AGREE TO BE BOUND BY THIS AGREEMENT OR THE PRIVACY POLICY, DO NOT USE THE SITE OR THE SERVICES.  Certain other Services may be provisioned in the future and your use of, or participation in, such Services may be subject to additional terms, and such terms will be either listed in this Agreement or will be presented to you for your acceptance when you sign up to use such Services.

The IAA services consist of the following, without limitation: a service for persons looking to improve and expand their social relationships (“General Service”), interactive content, any premium services offered by or on behalf of IAA (“Premium Services”).  IAA may offer additional services or revise any of the Services, at its discretion, and this Agreement will apply to all additional services or revised Services. IAA also reserves the right to cease offering any of the Services.However, nothing herein imposes any legal obligation on IAA to notify users of such provisioning or withdrawal.

This Agreement is subject to change by IAA in its sole discretion at any time and the notice of such change will be communicated to you in a manner IAA deems appropriate, including email.Your continued use of this Site or the Services after the posting of revisions to this Agreement will constitute your acceptance of such revisions. Please consult the end of this Agreement to determine when the Agreement was last revised.

1. Eligibility
   
   1. Minimum Age  You must be at least 18 years old to use the Site.  By using the General Service or Premium Services, you represent and warrant that you are at least 18 years old.
   2. Marital Status  By requesting to use, registering to use, or using the Services, you represent and warrant that  being single, you shall not seek for marriage a person of the same sex; and being married, you shall not seek a person for dating and/or marriage. If you are separated, but not yet legally divorced, you may not seek any person for dating or marriage.
   3. Criminal History  By requesting to use, registering to use, and/or using the Site or Services, you understand that IAA does not conduct any criminal background checks or screening of its members regardless of any other verification services that IAA may provide and is not liable for any consequence arising out of contacting any user, whether onsite or off-site.

2. Use of Site and Service
   As a user of the Site or a user registered to use any of the Services (a “Registered User”), you agree to the following:
   1. Exclusive Use  Your account is for your personal use only.  You may not authorise others to use your account, and you may not assign or otherwise transfer your account to any other person or entity. You acknowledge that IAA is not responsible for third party access to your account that results from theft or misappropriation of your user names and passwords. 
   2. Geographic Limitations  The Site and Services are intended for use by citizens of India, whether residing in India or abroad. You will only use the Services in a manner consistent with this Agreement and any and all applicable local, state, national and international laws and regulations.  Registration for, and use of, the Services are void where prohibited. To the extent that the Services are not legal in the jurisdiction where you reside, you may not use the Services. You further agree to waive any additional remedy provided by any law or regulation in force outside the Republic of India.
   3. Information Submitted  You are solely responsible for, and assume all liability regarding, (i) the information and content you contribute to the Service; (ii) the information and content you post, transmit, publish, or otherwise make available (hereinafter “post”) through the Services; and (iii) your interactions with other Registered Users through the Services. 
   4. Risk Assumption and Precautions  By using the site, you understand that you may be exposed to objectionable content.  You assume all risk when using the Services, including but not limited to all of the risks associated with any online or offline interactions with others, including dating as well as marriage. You agree to take all necessary precautions when meeting individuals through the Services. In addition, you agree to review the recommendations set forth in IAA’s Safety Tips, which is available at the bottom of all pages of the Site. However, please note that the Safety Tips are suggestions only and IAA has no legal obligations in this regard.
   5. No Guarantees  The General Service requires your completion of the basic registration questionnaire, along with IAA’s ability to find good matches for you. IAA may not be able to provide matches for everyone seeking to use its services. Occasionally, the IAA matching system cannot identify high quality compatible matches for a given individual, in which case such General Service cannot be provided. Further, IAA makes no guarantees as to the number or frequency of matches through the Services or to such matches’ ability, desire or criteria to communicate with any user. You understand that IAA makes no guarantees, either express or implied, regarding your ultimate compatibility with individuals you meet through the Site or Services or as to the conduct of such individuals.
   6. Reporting of Violations  You will promptly report to IAA any violation of the Agreement by others, including but not limited to, Registered Users. 
   7. Content Removal  IAA reserves the right, but has no obligation, to monitor the information or material you submit or post to the Services.  IAA will have the right to remove any such information or material that in its sole opinion violates, or may violate, any applicable law or regulation, either in letter or in spirit of this Agreement, or upon the request of any third party. Further, IAA reserves the right to remove any content from this site upon a request by any legal authority without notice to the content owner/supplier either prior to such removal or thereafter.
   8. Posting and Communication Restrictions  You agree that you will not post anywhere on the Site, transmit to other users, communicate any content (or links thereto), or otherwise display, upload, modify, publish, update, share any information, or engage in any activity on the Site or through the Services, that:
      1. Belongs to another person and to which the you do not have any right;
      2. Is grossly harmful, harassing, defamatory, inaccurate, disparaging, hateful, racially or ethnically objectionable, blasphemous, libellous, or promotes bigotry or physical harm;
      3. Is intended to or tends to harass, annoy, threaten or intimidate any other users of the Site or Services;
      4. Is obscene, profane, offensive, pornographic, paedophilic, or otherwise objectionable;
      5. Harms minors in any way;
      6. Relates to, solicits, or encourages money laundering or gambling;
      7. Is invasive of another's privacy;
      8. Infringes any patent, trademark, copyright or other proprietary rights including others’ copyrighted content (e.g., music, movies, videos, photographs, images, software, etc.) without obtaining permission first, as well as video, audio, photographs, or images of another person without his or her permission (or in the case of a minor, the minor’s legal guardian), or circumvents copy-protect devices;
      9. Deceives or misleads the addressee about the origin of any message or communicates any information which is grossly offensive or menacing in nature;
      10. Impersonates another person,or otherwise misrepresents affiliation, connection or association with, any person or entity, or obtain others’ identity information;
      11. Disseminates another person’s personal information without his or her permission, or collects or solicits another person’s personal information for commercial or unlawful purposes;
      12. Collects or solicits personal information about anyone under 18; or
      13. Intended to defraud, swindle or deceive other users of the Services;
      14. Promotes or solicits involvement in or support of a political platform, religion, cult, or sect;
      15. Contains software viruses,  trojan horses, worms, malware of any sort, or other harmful, or disruptive codes, components or devices or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;
      16. Uses scripts, bots or other automated technology to access the Site or Services;
      17. Uses the Site or Services for chain letter, junk mail or spam e-mails;
      18. Is in any way used for or in connection with spamming, spimming, phishing, phreaking, trolling, or similar activities;
      19. Promotes or enables illegal or unlawful activities in any manner whatever;
      20. Is off-topic, meaningless, or otherwise intended to annoy or interfere with others’ use and enjoyment of the Site;
      21. Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting to any other nation.

   9. Posting of links  Although we do not monitor the posting of links, you agree not to post any links to third party websites that would violate these Terms of Service or the Privacy Policy.  However, by posting links, you authorize us to use and permit others to use such links and content on the Site.
   10. No False Information  You will not provide inaccurate, misleading or false information to IAA or to any other user. If information provided to IAA or another user subsequently becomes inaccurate, misleading or false, you will promptly update such information or notify IAA of such change.
   11. Using Facebook API www.datedosti.com™uses Facebook API and OAuth 2.0 as an alternate method of authenticating users.  For further details, please visit Facebook Authentication.  By logging in using Facebook Authentication, you agree to abide by the Facebook Privacy Policy and the Facebook Statement of Rights and Responsibilities in addition to this agreement. 
   12. No Advertising or Commercial Solicitation  You will not advertise or solicit any user to buy or sell any products or services through the Site or Services. You will not transmit any chain letters, junk, spam e-mail, or malware to other users. Further, you will not use any information obtained from the Services in order to contact, advertise to, solicit, or sell to any user without their prior explicit consent. If you breach the terms of this subsection and send or post unsolicited bulk email, “spam” or other unsolicited communications of any kind through the Services, you acknowledge that you will have caused substantial harm to IAA, but that the amount of such harm would be extremely difficult to ascertain. As a reasonable estimation of such harm, you agree to pay IAAa minimum amount of Rupees Five Thousand (Rs 5000/-) for each such unsolicited communication you send through the Services.
   13. Unique and Bona Fide Profile  As a Registered User of the General Service, you will create only one unique profile. In addition, your use of the Site and  Service must be for bona fide relationship-seeking purposes in order to maintain the integrity of the Services (for example, you may not become a Registered User solely to write a review of the website or compile a report of singles in your area, or to write a news article). Not all Registered Users are available for matching. From time to time, IAA may create test profiles in order to monitor the operation of the Services.
   14. Selection of Profiles  From time to time, your profile may be displayed to introduce you to specific compatible matches.  You will be under no obligation to respond, communicate or to meet with the match(es) we may introduce to you.
   15. No Commercial Use  No information acquired for the site is to be used to be for any commercial purpose.  Specifically, information acquired from the site shall not used for collection, publication, preparing assimilated data, conducting surveys or the like.
   16. No Harassment of IAA Employees or Agents  You will not harass, annoy, intimidate or threaten any IAA employee or agent engaged in providing any portion of the Services to you.

3. Proprietary Rights
   
   1. Ownership of Proprietary Information  You hereby acknowledge and agree that IAA is the owner of highly valuable proprietary information, including without limitation, the compatibility matching system, compatibility profiles, and relationship questionnaires (collectively, “Confidential Information”). IAA owns and hereby retains all proprietary rights in the Services and the Site, including but not limited to, all Confidential Information.  Such Confidential Information does not include any personal information that has been submitted by Registered Users.
   2. No Use of Confidential Information  You will not post, copy, modify, transmit, disclose, show in public, create any derivative works from, distribute, make commercial use of, or reproduce in any way any (i) Confidential Information or (ii) other copyrighted material, trademarks, or other proprietary information accessible on the Site or via the Services, without first obtaining the prior written consent of the owner of such proprietary rights.
   3. Other Users’ Information  Other Registered Users may post copyrighted information, which has copyright protection whether or not it is identified as copyrighted. You agree that you will not copy, modify, publish, transmit, distribute, perform, display, commercially use, or sell any IAA or third party proprietary information available via the Services or the Site.
   4. License to Posted Content  By posting information or content to any profile pages or public area of the Site, you automatically grant, and you represent and warrant that you have the right to grant to IAA an irrevocable, perpetual, non-exclusive, fully-paid, sub-licensable, transferable, worldwide license to use, reproduce, publicly perform, publicly display and distribute such information and content, and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sub-licenses of the foregoing.  When you delete any such information posted, it is removed from the viewable section of the site.  However, the deleted information may persist in backup copies for a reasonable period of time in such a manner that no one other than administrators or authorized law enforcement authorities will have access to it.
   5. Additional features/programs From time to time, we may create, test or implement new features or programs on the Site. By your voluntary participation in such features or programs, you grant us the rights stated in this subsection in connection with the additional terms and conditions (if any) of such features or programs.
   6. Web Analytics We may monitor the site performance from time to time and in this regard collect site usage reports, advertisement banner statistics like impressions, click through rate, user demographic reports, usage reports, and other functions.  Your use of the Site or Services indicates your consent to such monitoring, collection, possession, and use of such information and statistics.

4. User Information.
   
   1. Privacy Statemen  For information about the collection and possible use of information and material provided by you, please click on IAA’s Privacy Policy located on the Site. By using the Site or the Services, you are consenting to the terms of IAA’s Privacy Policy. By logging in using Facebook Authentication, you further agree to abide by the Facebook Privacy Policy as well as the Facebook Statement of Rights and Responsibilities.
   2. No Contact Information  You agree that you will not post any physical or e-mail addresses, phone number, personal website address, or profile page you may have hosted on a third party website, or other contact information in any public section of the Site.
   3. Disclosure By Law  You acknowledge and agree that IAA may disclose information you provide if required to do so by law, at the request of a third party, or if we, in our sole discretion, believe that disclosure is reasonable to (1) comply with the law, requests or orders from law enforcement, or any legal process; (2) verify the identity, prevent, detect, investigate, prosecute, and punish offences where the Government Agency has stated in writing that the information obtained shall not be published or shared with any other person; (2) protect or defend IAA’s, or a third party’s, rights or property; or (3) protect someone’s health or safety, such as when harm or violence against any person (including the user) is threatened.
   4. Disclosure to Protect Abuse Victims  Not with standing any other provision of this Agreement or the Privacy Policy, IAA reserves the right, but has no obligation, to disclose any information that you submit to the Services, if in its sole opinion, IAA suspects or has reason to suspect, that the information involves a party who may be the victim of abuse in any form. Abuse may include, without limitation, domestic violence, child abuse, spousal abuse, neglect, or elder abuse. Information may be disclosed to authorities that IAA, in its sole discretion, deems appropriate to handle such disclosure. Appropriate authorities may include, without limitation, law enforcement agencies, the National Commission for Women (NCW),National Commission for Protection of Child Rights (NCPCR),Central Social Welfare Board (CSWB), National Institute of Public Co-operation and Child Development (NIPCCD), or court officials.  You hereby acknowledge and agree that IAA is permitted to make such disclosure.
   5. Use of Anonymous Information for Research  By using the Services, you agree to allow IAA to anonymously use the information from you and your experiences through the Services to continue IAA’s research into successful relationships and to improve the Services and user experience. Such research, conducted by accredited individuals or entities may be published. However, all of your responses will be anonymous, and we will not publish research containing your personal identifying information.
   6. Legal Compliance IAA, upon receipt of information pertaining to any violation of this agreement, or upon obtaining knowledge by itself, or, being brought to actual knowledge by an affected person in writing or through email signed with electronic signature, shall, within thirty six hours and where applicable, work with user or owner of such information, to disable such information that is in contravention of this agreement or the Information Technology Act, 2000 or its rules there under.  Further, IAA shall preserve such information and associated records for at least ninety days for investigation.  When required by lawful order, IAA shall provide information or assistance to Government Agencies who are lawfully authorised for investigative, protective, cyber security activity.  The information or any such assistance shall be provided for the purpose of verification of identity, or for prevention, detection, investigation, prosecution of cyber security incidents and punishment of offences under any law for the time being in force, on a request in writing stating clearly the purpose of seeking such information or any such assistance.
   7. Reporting of Violations IAA shall report cyber security incidents and also share cyber security incidents related information with the Indian Computer Emergency Response Team.
   8. Promotional Offers by IAA From time to time, IAA may undertake in promotional and publicity offers.  For this purpose, IAA may use information submitted by you that is available in the public portion of the website.  Such use may be by IAA itself or by Registered Users.  For example, IAA may display and publish your profile picture, your name, your basic information, your “story,” and your “icebreakers” and allow Registered Users to vote on your profile.  By joining and using the Site and Services you hereby consent to participating in such promotional and publicity offers.  The following additional terms govern such promotional and publicity offers:
   1. ELIGIBILITY Offers are open to Indian residents who have reached the age of majority (18 years).  Employees of IAA Social Networking Private Limited, its partners or licensees, and their immediate families up to the second degree of consanguinity or affinity, are not eligible to participate in these campaigns.  Entries are not transferable.
   2. CONDITIONS NO PURCHASE OR ENTRY FEES ARE NECESSARY TO ENTER OR WIN ANY OFFER.  Each offer closes at midnight (India time) on the last date of the offer.  Winners will be intimated by email.  If the prize is any tangible object, winners will have to claim the prize within 21 days.  Prizes may be subject to taxes which may be required to be paid by the winner.
   3. WINNING  The winner is decided on the basis of the rules set up by the IAA staff.  IAA’s decision is final and binding and no correspondence or phone calls in this regard will be entertained.  No cash substitution of the prize will be permitted.  In the event a winner chooses not to accept the prize, she or he forfeits all claim to that prize.

   The Services may contain links to third party websites, including without limitation, advertisements, which are not under the control of IAA, and IAA is not responsible for the content of any linked site or any link contained in a linked site, or any changes or updates to such web sites.  IAA provides these links to you only as a convenience, and the inclusion of any link does not imply that IAA promotes, endorses or accepts any responsibility for the content on such third party website. Your correspondence or business dealings with, or participation in promotions of, advertisers or sponsors found on or through the Services (including payment and/or delivery of related goods or services, any personal information voluntarily given to advertisers and sponsors, and any other terms, conditions, warranties or representations associated with such dealings) are solely between you and such advertiser orsponsor. You agree that IAA will not be responsible or liable for any injury, loss or damage of any sort incurred as the result of any such dealings, including the sharing of the information you supply to IAA with advertisers or sponsors, or as the result of the presence of such advertisers on the Services. 6. Disclaimer of Warranty
   
   1. No Warranties  THIS SECTION WILL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. ALTHOUGH IAA ATTEMPTS TO PROVIDE USERS WITH AN ENJOYABLE AND ENRICHING EXPERIENCE THROUGH THE USE OF THE SITE, IAA PROVIDES THE SERVICES ON AN “AS IS” AND “AS AVAILABLE” BASIS AND GRANTS NO GUARANTEES OR WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE WITH RESPECT TO THE SERVICES OR THE SITE (INCLUDING ALL INFORMATION CONTAINED THEREIN), INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.  IAADOES NOT WARRANT THAT YOUR USE OF THE SERVICES WILL BE SECURE, UNINTERRUPTED, ALWAYS AVAILABLE, ERROR-FREE OR WILL MEET YOUR REQUIREMENTS, OR THAT ANY DEFECTS IN THE SERVICES WILL BE CORRECTED.  IAA DISCLAIMS LIABILITY FOR, AND NO GUARANTEE OR WARRANTY IS MADE WITH RESPECT TO, THE CONNECTIVITY AND AVAILABILITY OF THE SERVICES.
   2. Third Party Content  Opinions, advice, statements, offers, or other information or content made available through the Services, but not directly by IAA, are those of their respective authors, and should not necessarily be relied upon. Such authors are solely responsible for such content. IAA DOES NOT: (i) GUARANTEE THE ACCURACY, COMPLETENESS OR USEFULNESS OF ANY INFORMATION PROVIDED ON THE SERVICES, OR (ii) ADOPT, ENDORSE OR ACCEPT RESPONSIBILITY FOR THE ACCURACY OR RELIABILITY OF ANY OPINION, ADVICE, OR STATEMENT MADE BY ANY PARTY OTHER THAN IAA. UNDER NO CIRCUMSTANCES WILL IAA BE RESPONSIBLE FOR ANY LOSS OR DAMAGE RESULTING FROM ANYONE’S RELIANCE ON INFORMATION OR OTHER CONTENT POSTED ON THE SERVICES, OR TRANSMITTED TO OR BY ANY USERS.
   3. Beta Features  From time to time, IAA may offer new “beta” features or tools with which its users may experiment on the Services. Such features or tools are offered solely for experimental purposes and without any warranty of any kind, and may be modified or discontinued at IAA’s sole discretion. The provisions of this Disclaimer of Warranty section apply with full force to such features or tools.

7. Limitation of Liability
   
   1. Incidental Damages and Aggregate Liability  IN NO EVENT WILL IAA BE LIABLE FOR ANY INCIDENTAL, SPECIAL, CONSEQUENTIAL OR INDIRECT DAMAGES ARISING OUT OF OR IN RELATION TO THE USE OR INABILITY TO USE THE SERVICES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OR CORRUPTION OF DATA OR PROGRAMMES, SERVICE INTERRUPTIONS, AND PROCUREMENT OF SUBSTITUTE SERVICES, EVEN IF IAA KNOWS OR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. UNDER NO CIRCUMSTANCES WILL IAA’S AGGREGATE LIABILITY, IN ANY FORM OF ACTION WHATSOEVER IN CONNECTION WITH THIS AGREEMENT OR THE USE OF THE SERVICES OR THE SITE, EXCEED THE PRICE PAID BY YOU FOR YOUR ACCOUNT, OR, IF YOU HAVE NOT PAID IAA FOR THE USE OF ANY SERVICES, THE AMOUNT OF RUPEES ONE HUNDRED OR ITS EQUIVALENT.
   2. No Liability for non-IAA Actions  TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL IAA BE LIABLE FOR ANY DAMAGES WHATSOEVER, WHETHER DIRECT, INDIRECT, GENERAL, SPECIAL, COMPENSATORY, CONSEQUENTIAL, AND/OR INCIDENTAL, ARISING OUT OF OR RELATION WITH THE CONDUCT OF YOU OR ANYONE ELSE IN CONNECTION WITH THE USE OF THE SERVICES, INCLUDING WITHOUT LIMITATION, HURT (AS DEFINED IN THE INDIAN PENAL CODE, 1860), EMOTIONAL HARM OR DISTRESS, MONETARY OR SOCIAL LOSS/INJURY, AND/OR ANY OTHER DAMAGES RESULTING FROM COMMUNICATIONS, ASSOCIATIONS, OR MEETINGS WITH OTHER USERS OF THE SERVICES. THIS INCLUDES ANY CLAIMS, LOSSES OR DAMAGES ARISING FROM THE CONDUCT OF USERS WHO HAVE REGISTERED UNDER FALSE PRETENSES OR WHO ATTEMPT TO DEFRAUD OR HARM YOU.
   3. Information Verification  At its option, IAA and its contractors may verify any information that users have provided. However, none of these ways are foolproof or perfect, and you agree that IAA and its contractors will have no liability to you arising from any non-verification or incorrectly verified information.

8. Indemnification
   You agree to indemnify, defend and hold harmless IAA, its promoters, officers, directors, employees, agents and third parties, for any injury, losses, costs, liabilities and expenses (including legal expenses) relating to or arising out of (a) your use of or inability to use the Site or Services, (b) any user postings made by you, (c) your violation of any terms of this Agreement or your violation of any rights of a third party, or (d) your violation of any applicable laws, rules or regulations.  IAA reserves the right, at its own cost, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with IAA in asserting any available defences.

    We may use your email address to send you messages notifying you of important changes to the Services or special offers.  Also, we may contact you by telephone if you voluntarily provide us with your telephone number, in order to communicate with you regarding the Services.By signing up for the services, you grant us express consent to contact you regardless of whether your number is listed in the National Do No Call Registry (NDNC registry) maintained by the Telecom Regulatory Authority of India.  You further expressly agree that any SMS, voice call, or mail received from IAA is not Unsolicited Commercial Communication (UCC) as defined in Telecom Unsolicited Commercial Communications Regulations, 2007.

11. Term and Termination
    This Agreement will become effective upon your acceptance of the Agreement by your use of the Site or the Services and will remain in effect in perpetuity unless terminated hereunder. Either you or IAA may terminate your account at any time, for any reason, effective upon sending written notice to the other party.IAA reserves the right to immediately suspend or terminate your access to any of the Services, without notice, for violation or non-compliance with Clause 2(g) or any other part of this agreement, or Privacy Policy, or for any other reason or no reason. If you know of any person who has violated Clause 2(g) of this agreement, please contact the Grievance Officer whose details are mentioned at the bottom of this page.  We also reserve the right to remove any non-compliant information, your account information or data, and any other records from our Services at any time at our sole discretion.You further agree that in the event of termination of account, some account information may be held in backups and some personal information may continue to be kept with IAA for a reasonable period of time.  In the event your access to any of the Services is suspended due to the breach of this Agreement, you agree that any payment paid to IAA by you will be non-refundable and any outstanding or pending payments will immediately be due. You may terminate your account by following the steps in the applicable section under “Termination” below, or by sending a notice of cancellation to: IAA Social Networking Private Limited, Attn:Terminations,A-178, Ground Floor, C-3, Saini Bhawan, Bhisham Pitamah Marg, Kotla Mubarakpur, New Delhi - 110 013, India, New Delhi, India.  Following any termination of any account, IAA reserves the right to send a notice thereof to other Users with whom you have corresponded.

12. Termination
    
    • Termination At Any Time With No Refund  Except as otherwise stated in this section, you may cancel your registration or subscription to any Services at any time during the term of such registration, subscription, or any renewal period by accessing the “Settings” page on your membership home page and clicking on the “Deactivate Your datedosti.com Account” link, and providing the information requested. In such case, your subscription will terminate at the end of seven working (7) days and you will not receive any refund for any unused days of such subscribed Premium Service.
    • Cancellation Due to Death  In case of death, your account will be closed immediately upon notice and all personal information maybe subsequently deleted.  If you are a legal representative of the account holder, please send us a signed affidavit stating clearly your name, contact information, relation to the deceased account holder, a request for deletion of the account, and a notarized copy of the death certificate.  Please note that in case of requests from law enforcement authorities, the deletion of personal and/or account informationmay be postponed to such time till when IAA determines in its sole discretion to be necessary.

13. Premium Service
    Use of the Premium Services may be subject to the additional terms and conditions and these will be notified at the time of subscription to such services.
    Renewals In order to provide continuous service, IAA automatically renews all paid subscriptions for the Premium Services on the date such subscriptions expire. Such renewals are generally for the same duration as the original subscription term (for example, a 1-month subscription will renew on a monthly basis, an annual subscription will renew on an annual basis, and so on).In addition, we may offer special promotions that have renewal periods of different duration than the original subscription term. We shall communicate renewal periods to you upon confirmation of your subscription as well as in the body of any special promotions that have renewal periods of different duration than the original subscription term.  Further, we shall send you an email notification informing you seven (7) days in advance of such automatic renewal.  By entering into this Agreement, you acknowledge that your account will be subject to the above-described automatic renewals. In all cases, if you do not wish your account to renew automatically, please cancel your subscription to the Premium Service before the date of expiry of the subscription.

14. General Provisions
    
    1. Applicable Law and Jurisdiction  You agree that laws of the Republic of India (without giving effect to conflicts of law principles) will govern this Agreement, the Site and the Services.  Any dispute arising out of or in relation to this Agreement, the Site or the Services will be subject to the exclusive jurisdiction and venue of the courts of Delhi. You acknowledge and agree that any violation of this Agreement may cause IAA irreparable harm, and therefore agree that IAA will be entitled to seek extraordinary relief in court, including but not limited to, preliminary injunctions and permanent injunctions, damages without the necessity of depositing any amount as security in addition to and without prejudice to any other rights or remedies that IAA may have for a breach of this Agreement.
    2. Grievances, Claims and Disputes  In case of any claim, dispute, or controversy, between you and IAA, the parties shall try and amicably resolve the dispute or controversy.  You shall approach IAA with such grievance or claim and the IAA will endeavour to address any issue.  In the event the parties fail to resolve the issue between themselves, the parties shall jointly appoint a mediator or a legal practitioner to mediate such issue.  In the event of arbitration, the arbitration would be governed by the provisions of the Arbitration and Conciliation Act, 1996.  Parties would together agree on an arbitrator, and the venue of the arbitration shall be Delhi.
    3. Legal Proceedings  No promoter, director, officer, or employee shall be impleaded as a party to any litigation or legal proceedings instituted against IAA.
    4. Miscellaneous
       • This Agreement, which you accept upon registration for the Services, the Privacy Policylocated on the Site, and any applicable payment, renewal, additional Services terms, comprise the entire agreement between you and IAA regarding the use of this Service, superseding any prior agreements between you and IAA related to your use of this Site or Services (including, but not limited to, any prior versions of this Agreement).
       • The FAQ’s found on the Services are for informational purposes only and are not deemed to be part of this Agreement.
       • Unless otherwise explicitly stated, the Agreement will survive termination of your registration to the Service.The failure of IAA to exercise or enforce any right or provision of this Agreement does not constitute a waiver of such right or provision.If any provision of this Agreement is held invalid, the remainder of this Agreement will continue in full force and effect. Regardless of any law or regulation to the contrary, any claim or cause of action arising out of or related to the use of the Site or this Agreement must be filed within six (6) months after such claim or cause of action arose or be forever time-barred.
       • The section titles in this Agreement are for convenience only and have no legal or contractual effect.

    If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on this Site, please notify IAAGrievance Officer with the following information:
    • Identification of the copyrighted work that you claim is being infringed;
    • Relation between you and the copyrighted work (eg, owner, agent, assignee, etc.)
    • Identification of the infringing work on the site (URL);
    • Information reasonably sufficient to permit IAA to contact you, such as your address, telephone number, and/or e-mail address.
